A new blogpost “Removing anonymity from prepaid phone cards: the law must play its role” has been published in April by Franck Dumortier on justice-en-ligne.be.
The blogpost discusses a judgement of 18 November 2021 in which the Belgian Constitutional Court recalls that in matters of privacy, a delegation to the executive power is contrary to the principle of legality if it concerns the execution of measures whose essential elements have not been determined beforehand by the legislator. In this case, the identification data of the prepaid phone cards’ owners that must be collected by the points of sale was not determined by a formal law but by a Royal decree.
